Terms and conditions
Article 1. Definitions
In these terms and conditions, the following definitions shall apply:
- Supplier: Wholesale Lashtag the legal entity offering products and/or services both in its webshop and remotely from the webshop to buyers;
- Buyer: Only a professional, legal entity or company with a Chamber of Commerce number that enters into an agreement (at a distance) with LASHTAG;
- Agreement (distance): an agreement under which, in the context of a system organised by LASHTAG for the sale (distance) of products and/or services, up to and including the conclusion of the agreement, exclusive use is made of one or more means of communication (distance);
- Technique for distance communication: means that can be used for concluding an agreement, without the customer and entrepreneur being together in the same room at the same time;
- Services and/or Products: The subject matter of one or more agreements.

Article 3. Applicability
- These general terms and conditions apply to any offer made by LASHTAG and to any (distance) agreement concluded between LASHTAG and the Buyer.
- In addition to these general terms and conditions, additional terms and conditions may apply to certain services and/or products. Should any differences exist between the additional terms and conditions and these general terms and conditions, the provisions of the additional terms and conditions shall in principle prevail over the general terms and conditions, unless otherwise provided by LASHTAG.
- One or more provisions of these general terms and conditions may only be deviated from if expressly agreed in writing. The other provisions of these terms and conditions shall in that case remain in full force and effect.
- Any general terms and conditions used by the Buyer shall not apply unless expressly agreed to in writing by LASHTAG.
- Unless otherwise agreed in writing, the general or specific terms and conditions or stipulations of third parties are not recognised by LASHTAG.
- The text of these general terms and conditions shall be made available to the Buyer by LASHTAG electronically in such a way that it can be easily stored by the Buyer on a durable data carrier.
- Before the agreement (at a distance) is concluded, the text of these general terms and conditions shall be made available to the Buyer. If this is not reasonably possible, before the agreement (at a distance) is concluded, it shall be indicated that the general terms and conditions can be inspected at LASHTAG and where the general terms and conditions can be inspected electronically and that at the request of the Buyer they will be sent electronically or otherwise free of charge.
- LASHTAG reserves the right to amend and/or supplement the terms and conditions at any time.
Article 4. The Offer and formation of agreements
- By using the webshop of LASHTAG and/or placing an order, Buyer accepts these terms and conditions as well as all other rights and obligations as listed on the webshop and applicable in the webshop.
- LASHTAG is authorised to use third parties in the execution of an agreement with the Buyer.
- LASHTAG's offer is non-binding unless the offer specifies a deadline for acceptance.
- Offers are valid while stocks last.
- If an offer has a limited period of validity or is made subject to conditions, this will be expressly stated in the offer.
- The offer contains a complete and accurate description of the products and/or services offered. The description is sufficiently detailed to allow a proper assessment of the offer by the Buyer. If LASHTAG uses images these are a true representation of the products and/or services offered. Obvious mistakes or errors in the offer do not bind LASHTAG.
- Each offer contains such information that the rights and obligations attached to the acceptance of the offer are clear to the Buyer.
- An agreement is concluded at the time when
-Potential Buyer has explicitly provided or entered data by telephone or in writing on the appropriate entry screen of the internet site and relevant data have been received by LASHTAG by telephone or via order form, post or e-mail;
- Potential Buyer has expressly stated during its visit to LASHTAG's premises that it wishes to purchase or receive a particular product and/or service;
-Potential Buyer has expressly stated by telephone that it wishes to receive a particular product and/or service. - Subject to the provisions of the previous paragraph of this article, the agreement comes into effect at the time of acceptance by the Buyer of the offer and fulfilment of the conditions set out therein.
- If the agreement is concluded electronically, LASHTAG shall take appropriate technical and organisational measures to protect the electronic transmission of data and shall ensure a secure web environment. If the Buyer pays electronically, LASHTAG shall observe appropriate security measures.
- LASHTAG may - within legal frameworks - inform itself whether the Buyer can meet its payment obligations, as well as of all those facts and factors that are important for a responsible conclusion of the agreement (at a distance). If, on the basis of this investigation, LASHTAG has good reasons not to enter into the agreement, LASHTAG is entitled to refuse an order or application or to attach special conditions to the execution, while giving reasons.
Article 5. Prices
- All prices are expressed in euros, in accordance with the legal regulations on the subject, and are exclusive of 21% VAT and other costs such as levies and shipping costs, unless otherwise indicated by LASHTAG.
- The Buyer shall owe the price that LASHTAG communicated to it in its confirmation. Obvious (manipulation) errors in the quotation, such as obvious inaccuracies, can be corrected by LASHTAG even after the conclusion of the agreement.
- Shipping costs are not included in the price. Special rates apply for shipping outside the Netherlands. With regard to certain payment methods, further conditions apply regarding the shipping method and related costs. This will be clearly communicated to the Buyer.
- Should prices for the offered products and services increase in the period between the order and its execution, the Buyer may cancel the order or terminate the agreement within ten (10) days after notification of the price increase by LASHTAG.
- VAT reverse charge for international customers. VAT reverse charge is possible for international customers with a valid VAT number. The VAT number should be entered in both columns "VAT/VAT number". If the VAT number is forgotten or needs to be changed later, this can be done free of charge within 30 days of the invoice date. After this deadline, an administration fee of €17.50 per invoice will be charged. These charges must be paid in advance.
Article 6. Payment
- Orders via the webshop can be paid in the following ways:
- cash (only on collection)
- prepayment / bank transfer
- ideal
- paypal.

- riverty - LASHTAG may expand payment options in the future. Other payment options will be made known through the website.
- LASHTAG may require an advance payment for some products and services. Where advance payment is stipulated, the Buyer may not assert any rights regarding the execution of the relevant order or service(s) before the stipulated advance payment has been made.
- Buyer has the duty to report inaccuracies in payment details provided or mentioned to LASHTAG without delay.
- In the event of non-payment or late payment by the Buyer, the Buyer shall owe interest on the outstanding amount, calculated from the day on which payment should have been made at the latest until the day of payment in full, whereby a started month shall be counted as a full month.
- The Buyer shall also be liable for all judicial and extrajudicial costs of any kind that LASHTAG has had to incur as a result of the Buyer's failure to comply with its (payment) obligations.
- In case of late payment, LASHTAG is entitled to terminate the agreement with immediate effect or to suspend (further) delivery until the Buyer has complied with its payment obligations in full, including payment of any interest and costs due.
Article 7. Marketing area
- Orders can be delivered worldwide.
- Agreements can only be concluded in Dutch/English.
Article 8. Delivery and delivery time
- Orders are delivered as soon as possible. In principle, LASHTAG aims to dispatch orders placed before 16:00 on a working day on the same day. The deadline for delivery is 30 days after receipt of the order, except for prepayments where the deadline is 30 days after receipt of payment.
- LASHTAG's obligation to deliver will, subject to proof to the contrary, have been fulfilled once the goods delivered by LASHTAG have been offered once to the customer. In case of home delivery, the carrier's report, containing the refusal of acceptance, shall serve as full evidence of the offer of delivery.
- LASHTAG may state further information on delivery times on the internet site or otherwise in writing. All terms mentioned on the internet site are indicative. No rights can therefore be derived from these terms.
- If a product, which is temporarily out of stock, is ordered by the Buyer, it will be indicated when the product is available again and sent back.
- LASHTAG aims to notify delays to Buyer by telephone or e-mail within one working day.
- Deliveries shall be made to the address provided by the Buyer during the formation of the agreement.
- Once the products to be delivered have been delivered to the specified delivery address / neighbours / collection point, the risk, where these products are concerned, passes to the Buyer.
- Different conditions may apply to deliveries abroad. If the country entered is incorrect, the order will automatically be cancelled.
- If the delivery is made in parts, LASHTAG has the right to consider each delivery as a separate transaction.
- If you receive items you did not order, you must notify LASHTAG within 48 hours.
Article 9. Trial period / right of withdrawal
- LASHTAG sales exclusively to companies. The customer the right to return (part of) the delivered goods within a period of 7 working days without giving reasons. This period starts when the ordered goods have been delivered.
- If the customer after the expiry of this period has not returned the delivered goods to LASHTAG, the sale is a fact. Before returning the goods, the customer must notify LASHTAG in writing within 7 working days after delivery. The customer must prove that the delivered goods were returned on time, for example by means of proof of postal delivery.
- Goods must be returned in the original packaging (including accessories and accompanying documentation), in new condition and within 7 working days after confirmation e-mail Lashtag. If the goods have been used by the customer, encumbered or damaged in any way, the right to dissolution within the meaning of this paragraph expires. LASHTAG reserves the right to charge administration costs in case of return.
- Subject to the provisions of the preceding sentence, LASHTAG shall ensure that within 30 days of proper receipt of the return shipment, the full purchase amount, excluding the calculated shipping and handling costs, is refunded to the customer. The return of the delivered goods is entirely at the expense and risk of the customer.
- The right of withdrawal does not apply to:
- services whose performance, with the consent of the Buyer, has begun before the deadline of seven working days;
- goods or services whose price is linked to fluctuations in the financial market, over which the supplier has no influence
- goods manufactured to the purchaser's specifications, e.g. custom-made goods, or of a clearly personal nature
- for goods or services which by their nature cannot be returned, e.g. for reasons of hygiene or which spoil or age quickly (including all liquid products, adhesives, pre- and after-care)
-products that have been assembled (e.g. moonlight etc.) cannot be returned. These can only be returned unused in their original packaging.
- tweezers, these are only tested extensively at lashtag for proper quality requirements. Due to hygiene reasons, we cannot take these back. - If the returned product is not received in accordance with the conditions, the purchase price will not be refunded. The product remains the property of the Buyer who is obliged to collect its property within two weeks. Upon request, the product can also be delivered, in which case the Buyer shall bear the delivery costs.
Article 10. Defects and complaint period
- The Buyer is obliged to carefully inspect the products (or have them inspected) immediately upon receipt.
- Complaints from the Buyer relating to defects in the product or delivery, which are externally observable, must be notified by the Buyer to LASHTAG within 7 days after delivery (or within 7 days after the invoice date if the products were not (or could not have been) delivered to the Buyer).
- The Buyer is not entitled to return the products for which no justified complaint has been made. If this happens without providing valid reasons, all costs related to returning the products shall be borne by the Buyer. LASHTAG shall in that case be free to store the products at the expense and risk of the Buyer with third parties.
Article 11. Retention of title
- Ownership of products shall, notwithstanding the actual delivery, only pass to the Buyer after the Buyer has paid in full all that he owes under any agreement with LASHTAG, including payment of interest and costs, including those of previous or subsequent deliveries and any work carried out or to be carried out in relation to the products.
- The Buyer may not encumber, sell, resell, alienate or otherwise encumber the products before ownership has passed.
Article 12. Warranty and liability
- In principle, products delivered by LASHTAG are covered by the guarantee as determined by the manufacturer of the relevant article. If the delivered item does not comply with the agreement, the Buyer shall notify LASHTAG within a period of two months after discovery. Natural persons not acting in the exercise of a profession or business who have entered into an agreement (at a distance) with LASHTAG shall have the rights set out in the Civil Code, Book 7, Title 1, Sections 1 - 7.
- LASHTAG shall never be obliged to pay any compensation to the Buyer or others, unless there is intent or gross negligence on its part.
- LASHTAG does not accept any liability for consequential or trading losses, indirect damage and loss of profit or turnover.
- If for any reason LASHTAG is obliged to compensate any damage, such compensation shall never exceed an amount equal to the invoice value relating to the product or service that caused the damage.
- Without prejudice to the provisions of this article, there can be no warranty in the following cases:
- if the wear and tear can be considered normal;
- if any changes have been made to or on the product, including repairs not carried out with the consent of LASHTAG or the manufacturer;
- if the original invoice cannot be produced, has been altered or rendered illegible;
- if defects are the result of improper or inappropriate use;
- if damage was caused by intent, gross negligence or negligent maintenance.
- return of products is at the buyer's expense. - If repairing a defect involves costs, the Buyer will be informed. If the Buyer does not expressly agree to the cost estimate in writing, she may receive her property back against payment of the investigation costs. If the Buyer has not paid these investigation costs (6) months after the offer of the cost estimate, the ownership of the product shall lapse to LASHTAG.
Article 13. Force majeure
- In case of force majeure, LASHTAG shall not be obliged to fulfil its obligations towards the Buyer. LASHTAG is entitled to suspend its obligations for the duration of the force majeure.
- Force majeure means any circumstance beyond its control as a result of which the fulfilment of its obligations vis-à-vis the Buyer is prevented in full or in part. Such circumstances include strikes, fires, operational disruptions, energy disruptions, disruptions in a (telecommunication) network or connection or communication systems used and/or the unavailability of the internet site at any time, non-delivery or late delivery by suppliers or other third parties called in and the absence of any permit to be obtained from the government.
Article 14. Personal data
- LASHTAG will only process Buyer's data in accordance with its privacy policy.
- In doing so, LASHTAG observes the applicable Dutch laws and regulations.
Article 15. Disputes
- Agreements between LASHTAG and the Buyer to which these general terms and conditions relate are exclusively governed by Dutch law.
- The parties will first make every effort to settle a dispute by mutual agreement.
- Disputes arising from an agreement between LASHTAG and the Buyer, which cannot be resolved by mutual agreement, shall be submitted to the competent court within the district of The Hague, unless LASHTAG prefers to submit the dispute to the competent court of the Buyer's domicile, with the exception of those disputes that fall under the competence of the cantonal court.
Article 16. Miscellaneous provisions
- LASHTAG aims to reply to e-mails sent to [email protected] within 24 hours.
- You must immediately report to LASHTAG any inaccuracies in the data provided to you by LASHTAG, as well as any changes or inaccuracies in your data that you have provided to LASHTAG.
